In compliance with the provisions of the Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce ("LSSI"), the purpose of this Legal Notice is to provide general information regarding the owner of the PASEQ, to inform about aspects related to intellectual and industrial property rights and to regulate the use - including the mere access - to the Website.

2. Intellectual and industrial property of the PASEQ

IrsiCaixa is the owner of the domain name https://paseq.org.

IrsiCaixa is the owner (unless expressly stated otherwise by specific quotation) of all content published in the PASEQ, including but not limited to all texts, graphics, interfaces, source codes, photographs, videos, trademarks, logos, sounds, songs and illustrations. The design, structure, selection, coordination, expression, style and organization of said content is protected by the corresponding intellectual and industrial property rights.

Notwithstanding the above, the PASEQ may include third-party software modules that are subject to an open source software (“OSS”) license agreement, which are governed under the applicable license terms thereof and to which additional rights and obligations may apply.

IrsiCaixa does not make any representation or warranty with respect to any OSS and shall in no event be liable for any claim arising out of or in connection with any direct, indirect, special, punitive, incidental or consequential damage related to any such OSS that may be included in the PASEQ.

To the extent required by the OSS license agreement, the terms of the OSS license agreement shall apply in lieu of the terms of this Legal Notice and of the Terms and Conditions solely with respect to said OSS, including, without limitation, any provisions governing access to source code, modification or reverse engineering.

User agrees to be bound by and comply with any OSS license agreement that applies to the PASEQ. User shall submit a request to the third-party licensor to obtain a source code copy of the OSS available to the public. A complete list of the used softwares can be found on the “About” section of the PASEQ once registered.

IrsiCaixa utilizes the OSS in compliance with the applicable third-party licensing terms under which said OSS is distributed and does not modify, distribute or violate any material respect of any OSS license in a manner that requires IrsiCaixa to disclose, distribute, permit reverse engineering, modify or otherwise make available the source code of the PASEQ in order to comply with the applicable OSS licenses.

User shall submit a request to the third-party licensor to request a OSS copy.

IrsiCaixa reserves the right to modify, update and/or eliminate without prior notice, the content, configuration, services and design of the PASEQ.

The access or use of the PASEQ is free and is made under the exclusive responsibility of the User. IrsiCaixa rejects any responsibility derived from the bad use of its contents.

The reproduction, copy, use, distribution, commercialization, public communication or any other activity that can be done with the PASEQ and that is carried out without the authorization of IrsiCaixa is an infringement punished by the current legislation. Notwithstanding the aforementioned, the User shall have the right to use, reproduce and distribute the resulting information from the PASEQ analysis in accordance with the provisions established in the Terms and Conditions.
